Immigration question I apply for asylum ,but my attorney did not submit my application until immigration?

Immigration question I apply for asylum ,but my attorney did not submit my application until immigration arrested me and at the same day my attorney file my case now my case is defensive or affirmative? I mean my case will go to the court or asylum office? Thank you

If you were served with a Notice to Appear, you can present your asylum request to the Immigration Judge. If you really needed asylum, you would have walked into an asylum office long before you were arrested.

If you can convince the Immigration Judge that you deserve asylum, it will be granted from the court.
